These Terms of Service (“Terms”) govern your use of elevationprox.com and related websites, forms, registration pages, checkout pages, and online services operated by The Elevation Project, LLC (“The Elevation Project,” “we,” “us,” or “our”). By using the Site or completing a purchase through the Site, you agree to these Terms.

2. Additional Terms

Certain transactions, events, programs, or services may be governed by additional terms. Event ticket purchases are also subject to our Event Registration & Attendee Terms, Refund & Cancellation Policy, and Privacy Policy. If an event registration page contains event-specific terms that differ from a general provision in these Terms, the more specific event disclosure will control with respect to that event to the extent permitted by law.

3. Eligibility

You must have legal capacity to enter into a binding agreement to make a purchase through the Site. Purchasers must generally be at least 18 years old. Elevation Project events are generally intended for adults age 18 and older unless an event page expressly states otherwise.

4. Permitted Use of the Site

You may use the Site for lawful personal or business purposes consistent with its intended functions. You agree not to violate applicable law; attempt unauthorized access; interfere with Site security or functionality; introduce malware; use unauthorized automated scraping; circumvent controls; impersonate another person; submit fraudulent information; make fraudulent purchases; infringe intellectual-property or privacy rights; use Site content for unauthorized commercial purposes; or disrupt the Site or its users.

5. Website Content

Site content is provided for general informational purposes. Although we attempt to provide accurate and useful information, we do not warrant that every item of Site content is complete, error-free, or current. Website content does not itself create a consulting, medical, professional, fiduciary, employment, or other professional-client relationship.

6. Intellectual Property

Unless otherwise indicated, Site content is owned by or licensed to The Elevation Project and may include text, articles, graphics, logos, photographs, videos, audio, presentations, training materials, event materials, course materials, downloads, website design, and software-related content. You may access Site content for personal and legitimate business reference purposes but may not reproduce, distribute, modify, publish, sell, license, commercially exploit, or create derivative works from protected Site content without authorization except where permitted by law.

7. Purchases and Payments

Ticket purchases and other transactions may be processed through WooCommerce and Stripe. You agree to provide accurate and current billing and transaction information and authorize the applicable payment provider to charge the payment method you submit for the total amount disclosed at checkout.

We may refuse, cancel, or review an order when reasonably necessary because of suspected fraud, unauthorized payment activity, pricing or technical errors, duplicate transactions, event capacity, legal restrictions, or other legitimate operational or security concerns. If we cancel an order after payment has been successfully collected for reasons unrelated to misconduct or fraud by the purchaser, we will provide an appropriate refund.

8. Pricing and Availability

Prices and ticket availability may change until a purchase is completed. Applicable fees, taxes, refund limitations, and material purchase conditions should be disclosed before an order is submitted. If an obvious pricing or technical error occurs, we may cancel the affected transaction and refund amounts collected rather than being required to honor an erroneous price.

9. Event Tickets

An event ticket represents a limited right to attend the applicable event subject to these Terms, the Event Registration & Attendee Terms, the Refund & Cancellation Policy, event-specific conditions, venue rules, and applicable law.

10. Refunds

Refunds are governed by our Refund & Cancellation Policy and any clearly disclosed event-specific terms. Please review the applicable refund terms before purchasing a ticket.

11. Third-Party Services

The Site uses or may link to third-party services, including payment processors, analytics providers, venues, social platforms, or other websites. Third parties operate under their own terms and privacy practices. We are not responsible for third-party websites or services that we do not control.

12. Communications

By completing a transaction, you agree that we may send communications reasonably necessary to administer the transaction or event. Marketing communications will be handled separately in accordance with our Privacy Policy and applicable law.

13. User-Submitted Content

If you voluntarily submit reviews, testimonials, comments, photographs, feedback, or other content for publication, you represent that you have the right to provide that content. Any right granted to The Elevation Project to publish or reuse such content will be governed by the context in which it was submitted and any additional agreement or permission requested at that time.

14. Disclaimer of Warranties

To the fullest extent permitted by law, the Site is provided on an “as available” basis. We do not guarantee that the Site will always be available, uninterrupted, secure, or free of errors. Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.

15. Limitation of Liability

To the fullest extent permitted by applicable law, The Elevation Project and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Site or a transaction made through it. For claims directly arising from a paid Site transaction, our aggregate liability will not exceed the amount you paid to The Elevation Project for the transaction giving rise to the claim, except where applicable law prohibits such a limitation.

16. Indemnification

To the extent permitted by law, you agree to be responsible for losses or claims arising from your unlawful use of the Site, your material violation of these Terms, or your infringement of another person’s rights. This provision does not require a consumer to indemnify The Elevation Project for our own unlawful conduct where such a requirement would be unenforceable.

17. Events Outside Our Reasonable Control

We are not responsible for delays or failures caused by circumstances outside our reasonable control, subject to any refund or other rights provided by applicable law or our Refund & Cancellation Policy. Such circumstances may include severe weather, natural disasters, governmental action, public emergencies, transportation disruptions, labor disruptions, venue closures, utility or technology failures, or other circumstances that materially affect an event or the Site.

18. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except to the extent another jurisdiction’s mandatory consumer-protection law applies. Subject to applicable law, disputes arising from these Terms or the Site may be brought in the appropriate state or federal courts located in or serving Franklin County, Ohio.

19. Changes to These Terms

We may modify these Terms from time to time. Updated Terms apply prospectively from their stated effective date unless otherwise required by law. Terms applicable to a completed transaction will generally be those disclosed at the time the transaction was completed.

20. Severability

If a provision of these Terms is determined to be unenforceable, the remaining provisions will continue in effect to the extent legally permitted.
